The date and data required for the EEO-1 report changed

The EEO-1 report time frame is delayed.

Many of you may have already read that the Office of Management and Budget (“OMB”) suspended the implementation of the new EEO-1 form until further review. The EEO-1 is a report required by the government (EEOC) for companies with over 100 employees. Historically it has been due on September 30th of each year. However, in 2016 the form was revised. It was to include salary data for all the employees that were included in the report. However, this stay by the OMB basically removes the salary data. It does not however remove the requirement of reporting the statistical data on employee populations. According to the EEOC website:

The 2017 EEO-1 will continue to collect race, ethnicity and gender data by job category and will not include the collection of pay and hours worked data.  Reports must be submitted and certified by March 31, 2018.  The employment data used for the 2017 EEO-1 report should be selected from a payroll period in October, November or December, the fourth quarter of calendar year 2017.

Because this form is filed electronically all employers must have a registered password. The EEOC has announced that the password you used last year will NOT work next year.

If this is your first year of having over 100 employees you need to register and file this report next spring.
